TERMS AND CONDITIONS
the Cloudpacking service and sale of products (the "Service").
III. Dates and times
All dates and times should be understood to be in Paris, France time, including and in particular order and cancellation deadlines and delivery and collection dates.
IV. The Cloudpacking service
Procedure to book a suitcaseThe customer fills in an order form to have a suitcase packed with outfits in the customer's size and toiletries, selected specially for him. The order form can be filled in through the "Book a Suitcase" page on the website or by using a purpose made form sent by Cloudpacking via email to the customer. No other method will be accepted by Cloudpacking. Delivery Date, Collection Date, number of outfits required, exact name, address and booking reference of hotel, underwear option preference and clothing sizes must all be filled in for the order form to be processed. The customer receives an email to confirm his order and a means to make the payment for the Service. The order can only be taken if payment reaches us at the latest 9 days before the requested Delivery Date. If payment does not reach us in enough time, no matter for what reason, the order will be cancelled. Along with payment of the Service fee, the customer will be asked to pay an additional refundable deposit which will be determined by us, based on the cost of replacing the suitcase and its contents. Cloudpacking will not be held responsible for the consequences of any mistakes made in the order form.
Delivery of the suitcaseOn the requested delivery date, the suitcase is delivered to the customer's hotel or any other building which has been previously agreed on between the customer and Cloudpacking and where a person is present, able and willing for the whole day, to receive the suitcase, keep the suitcase in suitable conditions and ensure that it is neither stolen nor damaged.
Contents of the suitcaseYour cloudpacked suitcase will contain items of clothing and accessories which will have been previously worn or used. Underwear items will not have been previously worn. The customer agrees that Cloudpacking will pick out all the items in the suitcase based on local customs and fashions and will not take into account the customer's personal taste, cultural background or religious preference. The customer accepts that this means the suitcase he receives may contain items that are not to his liking and/or that he is not used to and/or that he does not find comfortable.
Rental and use of the contents of the suitcaseThe customer is responsible for the suitcase and all of its contents from the time the person delivering the suitcase from Cloudpacking hands it over on the delivery date to the time it is the person from Cloudpacking collecting the suitcase picks it up on the collection date. The suitcase, its cover and all its contents except those bought by the customer, must be returned to Cloudpacking and in good condition. Under no circumstance is the customer to attempt to clean any of the items from the suitcase themselves. The customer agrees to pay for any damage which may occur to the suitcase and its contents. The customer agrees to use the contents of the suitcase strictly for the purpose they were conceived for. Cloudpacking places inserts and otherwise makes adjustments to items which will be re-used. The customer agrees to not remove any protective inserts, alter any additions or modifications made by Cloudpacking to articles of clothing or accessories. Any electrical appliances provided will be built to work on French style electrical sockets delivering a 220V current. Customers who are unsure how to operate or use any appliance, product, accessory or item of clothing from the suitcase must absolutely not use it.
Purchase of articlesCloudpacking offers the option to purchase and keep selected items from the suitcase. A price list for these items is included in the suitcase. The customer must get in touch with us at least 24 hours before the collection date if he wishes to exercise this option. The customer understands and accepts that items in the suitcase, including those with a purchase option, are not new and have been worn by previous customers. Any item bought from Cloudpacking is bought "as is". Cloudpacking will accept no responsibility for the items once they have been purchased by the customer and will issue no refunds on items purchased from the suitcase.
Collection of the suitcaseThe customer will ensure that the suitcase is complete, closed and ready to be collected by 10 am on the required collection date. If he is not present at time of collection, it is the customer's responsibility to ensure that the suitcase is properly stored and kept safe from damage or theft until the person from Cloudpacking comes to pick it up.
Refund of the depositCloudpacking will check the suitcase and its contents for missing or damaged items. If nothing is missing or damaged, we will issue a refund of the deposit within 10 days after the collection date. If damage has occurred or items have been misplaced, Cloudpacking will evaluate the costs of either repair if possible or replacement of items and will send notice to the client of these costs within 10 days and refund to the customer the difference between the initial deposit and the costs.
All prices are in euros and include VAT, delivery and shipping costs. Cloudpacking only accepts payment in euros. Cloudpacking cannot be held responsible for any extra charges or costs that may arise from this. An invoice will be sent to you by email after your payment has been processed.
You can cancel your order at any time. If you have already paid for it and have cancelled 11 days or more before the required delivery date, then we will issue a full refund. If the order is cancelled between 10 and 2 days before the required delivery date, we will issue a refund of 50% of the amount paid. If the order is cancelled in the 48 hours preceding the required date of delivery, no refund of the service fee will be issued. The deposit will be refunded in full, regardless of time of cancellation.
VIII. Access to the Service
The use of our Service requires an internet connection and mobile phone connection. It is the customer's responsibility to make sure he will have 24 hour access to both in the weeks before the required Delivery Date, during the time our suitcase is in his possession and in the weeks following the required Collection Date. Cloudpacking may call, text message or email the customer during his stay in France, this may induce extra charges for the customer. Cloudpacking will not be held liable for these charges.
IX. Intellectual Property
Cloudpacking is a trademark of Cloudpacking. All Cloudpacking graphics, logos, page headers, button icons, scripts and service names are trademarks of Cloudpacking. Any trademarks not owned by Cloudpacking that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Cloudpacking. All content and compilation thereof on the Site, including, but not limited to, text, graphics, logos, designs, photographs, button icons, images, data compilations and software, is the property of Cloudpacking or its product suppliers, and is protected by copyright laws. No material, including but not limited to, the material listed above should be reproduced or used without our express written permission.
X. Links and advertising
We may provide or third parties may provide links to other websites or resources that are beyond our control. We make no representations as to the quality, suitability, functionality or legality of any websites to which links may be provided and you hereby waive any claim you might have against us, with respect to such websites.
All applicable local, city and state taxes are your responsibility. You agree to pay these taxes.
XII. Final provisions
- Cloudpacking's failure to act in a particular circumstance does not waive its ability to act with respect to that circumstance or similar circumstances.
- By using the Site or the Service, you consent to receiving electronic communications from Cloudpacking. These communications will include notices relating to current, past or future transactions and information concerning or related to the Service. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
- Cloudpacking is excused for any failure to perform to the extent that its performance is prevented by any reason outside of its control.
